Please note that the Application is a tool intended for professionals in the electrical sector. Therefore, by creating your Account, you confirm that you are a user acting for the purposes of your professional activity.

Use of the Application implies your acceptance of these General Terms and Conditions of Use. We encourage you to read them carefully.

Account Creation

In order to access our Application, we require you to create an Account. Please note that the Application cannot function without this prerequisite.

Creating an Account implies your unreserved acceptance of these Terms and Conditions of Use.

By creating your Account, you confirm that:

• The information you provide is accurate.
• your username and password, which must be sufficiently secure, are personal to you and will not be used by third parties to access the Application.
• you will not do anything that would allow an unregistered third party to access the Application.
• You are not creating an Account to misuse the features offered by the Application or to impersonate another user.

You agree to immediately notify Bticino, at the address mentioned in the "Legal Notice" section, of any unauthorized use of your Account, username, or password.

You must keep your username and password strictly confidential and must not disclose or share them with any third party. You must also take the necessary steps to ensure their security.

If Bticino has legitimate grounds to believe that the security of the Application is compromised or that your login credentials are being used without authorization, it may temporarily suspend your Account, particularly to protect the integrity of the Application and data, and, if deemed appropriate, require you to change your login credentials.

You are free to unsubscribe at any time:

Intellectual Property Rights

Unless expressly stated otherwise, the Legrand Group is the exclusive owner of all intellectual property rights relating to both the structure and content of the Application. All patents, logos, texts, layouts, visuals, photographs, graphics, icons, and all other distinctive elements contained in the Application are the exclusive property of the Legrand Group and Bticino.

These General Terms of Use do not transfer any intellectual property rights to you, either in the structure or the content of the Application.

Any reproduction or representation, in whole or in part, for purposes other than your personal and private use for non-commercial purposes, on any medium and by any means whatsoever, is strictly prohibited without the written authorization of the Legrand Group. Any infringement of intellectual property rights constitutes counterfeiting.

You expressly agree that your use of the Application will in no way infringe upon the rights of the Legrand Group.

Personal Data

Bticino processes your personal data in accordance with applicable regulations. You can find more information in the "Privacy Policy".

Guarantees and Liabilities

Given the technical characteristics of the internet network used for the purpose of using the Application, you acknowledge and accept the risks arising directly or indirectly from the provision and transmission of data over this network.

While Bticino strives to provide reliable Application and takes every care in their operation, errors may still occur in the Application.

Under no circumstances shall Bticino be liable for any direct or indirect damages that may result from accessing the Application or using the information it contains (e.g., errors, omissions, inaccessibility, data loss, damage, destruction, or viruses that may affect your computer equipment).

Therefore, you are invited to carry out all necessary checks.

Bticino has implemented measures designed to ensure the security of personal data collected on the Application. However, Bticino wishes to draw users' attention to the potential risks to data confidentiality associated with internet operation. In particular, Bticino cannot be held liable for the presence of viruses on the Application or any other malicious software (worms, Trojan, spyware, etc.). In this regard, you agree to take all necessary security measures. Consequently, you acknowledge that you use the Application at your own risk and are advised to carry out all necessary checks. Specifically, you are responsible for implementing or ensuring the existence of measures to secure your personal computer network, as well as ensuring the correct configuration of the internet connection box (router) connected to your internet service provider, and other wireless access points (e.g., Wi-Fi, 4G, etc.).

Bticino cannot be held liable in the event of an interruption of access to the Application. Furthermore, Bticino may temporarily or permanently suspend access to the Application.

To ensure the efficiency and security of the services, we reserve the right to modify the technical specifications of the services at any time.

In the event of force majeure or unforeseen circumstances (such as interruptions in connections and/or power supply), Bticino reserves the right to suspend or discontinue the operation of the Application without prior notice. Force majeure shall suspend Bticino's obligations for the duration of the force majeure event. Specifically, the following are considered force majeure events, in addition to those meeting the criteria established by Italian law and case law: fires, storms, lightning, strikes, floods, earthquakes, epidemics, terrorist attacks, explosions, wars, military operations or civil unrest, blockages of transportation or supply routes, power outages, computer viruses, electrical and electromagnetic phenomena that disrupt mobile networks, any legislative or regulatory restriction on the provision of all or part of the Application, and any decision by a public authority not attributable to Bticino that prevents the provision of the Application, particularly those related to commerce imposed by a national or international body or authority, as well as any modifications thereof, and, in general, any events requiring the implementation of local or national plans to maintain the continuity of telecommunications services.

Terms of Use

Bticino grants you the right to view, use, and access the Application. You are solely responsible for the equipment and resources required to access the Application, including telecommunications costs.

You may only use these Application in accordance with these Terms of Use and the applicable laws of the country of use.

In particular, you agree to :

• not publish, transmit, or distribute any harmful, obscene, indecent, abusive, harassing, defamatory, or unlawful information, or information that threatens or encourages physical violence or the destruction of property, either on or through this Application.
• not use these Application in a manner that may infringe upon the rights of others; not copy, paste, reproduce, or extract, in whole or in part, on any medium and by any means whatsoever, the content and elements appearing on these Application, without the prior written authorization of Bticino.
• Do not copy all or part of the Application onto another application, website, or internal company network.
• Do not create hyperlinks to the Application without the prior written authorization of Bticino.
• Do not perform any unauthorized, false, or fraudulent actions
• Do not use any "routine" software, Trojan, or any computer code, files, or other malicious software, not to use any code or device designed to disrupt, destroy, invade, gain unauthorized access to, corrupt, observe, or modify without authorization any data, software, computers, network devices, or telecommunications equipment, or to interfere or attempt to interfere with the proper functioning of the Application, by any means whatsoever, including, but not limited to, uploading or making available files containing corrupted data or viruses;
• not to degrade, alter, or modify the graphic appearance of these Application or the software code that constitutes them.
• not to undertake any action likely to cause unreasonable or disproportionate traffic on the Application or on any related infrastructure.
• not to obtain or attempt to obtain unauthorized access to any of our networks, by any means whatsoever.
• not implementing systems that are likely to, or are capable of, in whole or in part, infringing or engaging in unfair competition with the Application, or that are likely to violate these Terms of Use.
• You must inform Bticino as soon as you become aware of any infringement, particularly in the event of illegal or prohibited use of the Application content or hacking.
• You must verify that the computer system you are using is free of viruses and in perfect working order.

Without prejudice to any of its other rights, Bticino reserves the right to close your Account without notice if it deems, at its sole discretion, that you are violating any provision of these Terms of Use or applicable laws.

If any provision of these Terms of Use is found to be invalid, this will not affect the other provisions of these Terms of Use.

Bticino may still take action at a later date. Bticino reserves the right to make improvements or changes to the information, services, products, and other elements of these Application, or to close them, at any time without prior notice.

If any provision of these Terms of Use is found to be invalid, this will not affect the validity of the remaining provisions.

Modification of the Terms of Use

Bticino reserves the right to modify these Terms of Use at any time. In such cases, we will inform you of any changes and ask you to renew your consent to the terms of this document.

Disputes

The Application and their terms and conditions of use are governed by Italian law, regardless of the place of use. In the event of any dispute, and after all attempts to reach an amicable solution have failed, the courts of Milan, Italy , shall have territorial jurisdiction over any dispute relating to the Application.
